License Agreement and Terms of Use — Whats-SE
This Agreement governs use of the Whats-SE application ("Application"), provided by PAGOTTO SALES ENGINE TECNOLOGIA DA INFORMAÇÃO LTDA ("Sales Engine"), CNPJ 06.035.381/0001-20, with its registered office at Rua Conceição, 233, Sala 1006, Centro, Campinas/SP, CEP 13010-050, Brasil. By installing or using the Application, you ("User") agree to these terms.
1. Purpose
The Application is an integration connecting WhatsApp channels to Bitrix24 (customer service, sending/receiving messages and files, history and management). Campaigns, templates and automations may be included according to the subscribed plan.
2. Paid external service
The Application depends on the Whats-SE service from Sales Engine, a paid external subscription service. A free 20-day trial is available for Start and Business plans; afterwards, an active monthly or annual subscription is required to continue.
- Billing is processed by Stripe; prices and conditions are available on the service page: https://salesengine.cloud/whatsse.
- Meta Cloud API charges (sending messages/templates) are not included in the plans and are billed by Meta.
- Without an active subscription, the external messaging service may be suspended, subject to the grace period.
3. Registration, accounts and responsibility
The User is responsible for accurate information, safeguarding credentials and use in compliance with applicable law and Meta and Bitrix24 policies.
4. Acceptable use
Using the Application for spam, unsolicited messages in violation of Meta/WhatsApp policies, unlawful content or any practice that violates laws or third-party rights is prohibited.
5. Intellectual property
The Application, its brand and code belong to Sales Engine. The User is granted a limited, non-exclusive and non-transferable license to use it during the subscription term.
6. Third-party trademarks
WhatsApp, Meta and Bitrix24 are trademarks of their respective owners. The Application does not represent a partnership, certification or official integration with Meta beyond the features described.
7. Warranties and limitation of liability
The Application is provided "as is". To the maximum extent permitted by law, Sales Engine is not liable for indirect damages, lost profits or third-party outages (Meta, Bitrix24, providers). Total liability is limited to amounts paid in the preceding 12 months.
8. Suspension and cancellation
The User may cancel the subscription at any time through the management portal. Uninstalling the Application in Bitrix24 ends access; data handling upon uninstall follows the Privacy Policy.
9. Privacy
Personal data processing follows the Privacy Policy, which forms an integral part of this Agreement.
10. Governing law and jurisdiction
Brazilian law applies. The courts of the District of Campinas/SP are designated to resolve disputes.
